Terms of Service
Effective date:
These Terms of Service ("Terms") govern your access to and use of Blog Maker's websites, applications, and related services (collectively, the "Service"). By creating an account, clicking to accept, or using the Service, you agree to these Terms on behalf of yourself or the organization you represent. If you do not agree, do not use the Service. A separate order form, enterprise agreement, or data processing addendum may apply to your organization and, where they conflict with these Terms on a specific point, the signed agreement controls for that point.
The Service
Blog Maker helps teams create, refine, schedule, and publish blog content with AI-assisted drafting, brand settings, SEO-oriented structure, and workflow tools (including dashboards, pipelines, and integrations you enable). We may modify, add, or discontinue features to improve the Service, provided we do not materially reduce core functionality you have paid for during a current subscription term without reasonable notice where required.
Eligibility and accounts
You must be able to form a binding contract in your jurisdiction. You are responsible for the accuracy of registration information and for maintaining the confidentiality of your credentials. Notify us promptly of unauthorized use. If you administer users for an organization, you are responsible for invitations and permissions you grant.
Subscriptions, trials, and fees
Access may be offered on a trial, subscription, or custom-quoted basis. Fees, billing cycles, and taxes are as stated at checkout, in an order form, or in your admin console. Unless otherwise agreed, subscriptions renew automatically until cancelled. We may suspend or limit the Service for non-payment after notice where appropriate.
Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, deceptive, or infringing purposes.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems; probe, scan, or test vulnerabilities without authorization.
- Reverse engineer, scrape, or overload the Service except to the extent applicable law permits despite this limitation.
- Generate or distribute content that violates applicable law, third-party rights, or our content policies (including malware, spam, hate, harassment, or sexual content involving minors).
- Misrepresent AI-generated content as human where such disclosure is required by law or our policies.
We may investigate violations and suspend or terminate access. Government or enterprise customers may have additional acceptable-use obligations in their agreements.
Your content
You retain ownership of content you submit ("Customer Content"). You grant Blog Maker a worldwide, non-exclusive license to host, process, transmit, display, and create derivative outputs (such as generated drafts) solely to provide, secure, and improve the Service for you, and as described in our Privacy Policy. You represent that you have the rights needed to submit Customer Content and that its use in the Service will not violate law or third-party rights.
AI-generated output
Outputs may be probabilistic and incomplete. You are responsible for reviewing, editing, and approving content before publication. Blog Maker does not guarantee rankings, traffic, or revenue. You should verify facts, comply with advertising and disclosure rules, and ensure outputs meet your brand and legal standards.
Our intellectual property
The Service, including software, branding, and documentation, is owned by Blog Maker and its licensors. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
Third-party services
The Service may interoperate with third-party platforms (for example, hosting providers, social networks, or CMS tools). Your use of those services is governed by their terms. Blog Maker is not responsible for third-party services you choose to connect.
Confidentiality
Each party may receive non-public information from the other ("Confidential Information"). The recipient will use reasonable care to protect it and use it only for the purpose of the Service. Exclusions include information that is public, independently developed, or rightfully received from others.
Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, risk, or legal requirements, with notice where reasonable. Upon termination, your right to use the Service ceases. We may delete Customer Content after a retention period consistent with our Privacy Policy and backups. Sections that by nature should survive (including disclaimers, limitations, and indemnity) survive termination.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOG MAKER DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER BLOG MAKER NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO BLOG MAKER FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT PAID FEES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
Indemnity
You will defend and indemnify Blog Maker and its affiliates, officers, and employees against third-party claims, damages, and costs (including reasonable attorneys' fees) arising from Customer Content, your use of the Service in violation of these Terms, or your violation of law or third-party rights.
General
Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. The courts located in Delaware will have exclusive jurisdiction for disputes, subject to mandatory consumer protections in your country of residence where applicable.
Export
You will comply with export control and sanctions laws. You may not use the Service in embargoed countries or by prohibited parties.
Assignment
You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Entire agreement; severability
These Terms, together with the Privacy Policy and any order form, are the entire agreement. If a provision is unenforceable, the remaining provisions remain in effect.
